Twin Terms of Use
For purposes of these Terms of Service, the term "Services" refers to all of the following, collectively:
- The Twin application, or it's then-current name,
- The software known as Twin and its derivatives, components, spinoffs, and related software,
- 1984 LLC, the owner and operator of the application, or its then-current owner, and
- Any and all services provided by or through the application and related applications, regardless of how they are referred to within these Terms of Service.
By using Twin you agree you're 18 years old or older and can pay money if you choose to subscribe.
By uploading User Content to the public portion of the Twin app, you grant Twin and its owner a worldwide, irrevocable, royalty-free, sublicensable, transferable, and non-exclusive license to:
- Use, reproduce, modify, adapt, publish, translate, distribute, display, perform, and create derivative works of your User Content for any purpose, commercial or non-commercial, without limitation in any format through any channel.
- Include your User Content in marketing materials, promotional content, and other materials related to the Service.
- Sub-license your rights in the User Content to third parties.
Content found on the Services, through the Services, introduced by the Services, or otherwise facilitated through the Services are the property of 1984 LLC, Twin, or its then-current owner. You may not distribute, modify, transmit, reuse, download, repost, copy, remix, archive, aggregate, resell, sell, bundle, scan, ingest, or otherwise use said Content, whether in whole or in part, for any purposes without express advance written permission from Twin's owner.
You waive any moral rights you may have in your User Content, which means you will not object to any way we use or modify your User Content.
You represent and warrant that:
- You have all necessary rights, licenses, and permissions to grant the license set forth above.
- Your User Content will not infringe on the intellectual property rights of any third party.
- Your User Content does not violate any applicable laws or regulations.
- You have the right to consent to the processing of any personal data contained in your User Content.
You are solely responsible for the User Content you upload to the Service. You agree to indemnify and hold harmless Twin and its owner from any and all claims, losses, damages, and expenses (including attorneys' fees) arising out of or related to your User Content or your use of the Service.
Twin and its owner shall not be liable for any claims, losses, damages, or expenses arising out of or related to your User Content or your use of Twin. This includes, but is not limited to, any claims of infringement of intellectual property rights, defamation, or privacy violations.
Twin and its owner reserve the right to remove any User Content from the Service at any time, for any reason, in our sole discretion. This includes, but is not limited to, content that we believe violates these Terms of Service, infringes on the rights of others, or is otherwise objectionable.
All intellectual and industrial property rights and other exclusive rights on software or technical applications embedded in or related to Twin are held by 1984 LLC.
There are paid elements of Twin. All payments, refunds, payment processing, and payment issues are handled by Apple. The user assumes any payment related costs or fees.
Subscriptions begin on the day payment is received. By subscribing, users agree payment will be charged to their Apple ID account, subscriptions are automatically renewed for the same duration unless the user cancels at least 24 hours before the current period expires, any and all fees or payments due for renewal will be charged within 24-hours before the end of the current period, subscriptions can be managed or canceled in the user's Apple App Store account settings.
Users agree Twin and its owner are not liable for anything that could possibly come about related to Twin. Twin and its owner are not liable for any damages related to Twin. Users agree to defend, indemnify, and hold harmless Twin and its owner for anything related to Twin.
You agree to not hack, steal, resell, or post objectionable content to Twin. You agree to not use Services for any purposes that violates national or international law or regulation. You agree to not use any robot, spider, automated services, automated processes, or other means to access Service outside of personal use.
No rights to any intellectual property are granted to users.
Use as-is. No warranties granted nor promises made.
These terms may change, you agree to be bound to the then-current version of the terms of service. Your continued use of these Services following the posting of revised Terms means you accept and agree to the changes. You must check this page often to be made aware of changes, as they are binding. These terms and conditions are governed by the laws of Illinois, USA and you irrevocably submit to the exclusive jurisdiction of the courts in Illinois.
If you violate or disagree with any of these Terms, you are banned from using Twin with no recourse for any lost data.
Except as indicated or superseded above, usage of Twin is also covered by Apple's App Store EULA.
